Terms and Conditions


1. Introduction

Welcome to JKP Photography LLC. These Terms and Conditions govern your use of our website and services. By accessing or using our services, you agree to comply with and be bound by these terms.


2. Services

We provide professional photography and videography services, including but not limited to event photography/videography, portrait photography, commercial photography/videography, and more. Specific service details, including deliverables and pricing, will be outlined in individual contracts or agreements.


3. Booking and Payment

Booking: A non-refundable retainer of 50% of the overall total or payment in full is required to secure your booking. The remaining balance is due 48 hours (2 days) before the date of the photoshoot/videoshoot.


Payment Methods: We accept online payment via invoice. We also accept mobile payments via Cash App, Zelle, Apple Pay, and Venmo. Use business numbers or email for mobile payment.

Travel Fee: A travel fee of $150 will be applied for any bookings outside of Fresno, CA.


Late Payment Fee: A late payment fee of $150 will be charged for any payment not made on time.


Late Arrival Fee: A late fee of $50 will be charged if the client is late to the scheduled photography/videography booking. 


 Cancellation Policy: 

More than 30 Days Before the Event:

 If the client cancels the booking more than 30 days before the scheduled event date, no further payment is required. However, the deposit will not be refunded.

15-30 Days Before the Event:

  Less than 15 Days Before the Event:

 If the client cancels the booking less than 15 days before the scheduled event date, the client will be responsible for 100% of the total agreed-upon fee.



If the client needs to reschedule the event, we will do our best to accommodate the new date. Rescheduling requests made more than 30 days before the event will incur no additional fee. Rescheduling requests made within 30 days of the event may incur a rescheduling fee of [Rescheduling Fee], depending on availability and the nature of the change.


Weather Policy

For outdoor events, if inclement weather is expected, the client may reschedule the event once at no additional cost, provided that the rescheduling is arranged at least 48 hours before the event.


Photographer/Videographer Cancellations:

In the unlikely event that JKP Photography LLC needs to cancel the booking, we will provide a full refund of all payments made, including the deposit. We will also make every effort to find a suitable replacement photographer/videographer to cover the event.


Force Majeure:

Neither party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, or military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.


Return and Refunds:

Due to the nature of digital products, all sales are final. Once digital products (photos, videos, etc.) are delivered, they are deemed accepted by the client and are non-refundable. 


Refund Eligibility

Refunds may be issued at our discretion under the following circumstances:

Technical Issues: If the delivered digital product is corrupted or cannot be accessed, and we are unable to provide a functional replacement within a reasonable timeframe.

Non-Delivery: If the digital product is not delivered within the agreed timeframe, and the delay is not due to unforeseen events or force majeure (see section on Force Majeure below).

Service Quality: If there is a significant quality issue that does not meet the agreed-upon specifications outlined in the contract, and we are unable to rectify the issue within a reasonable timeframe.


Requesting a Refund

To request a refund, clients must contact us within 7 days of receiving the digital product, providing a detailed description of the issue and any supporting evidence (e.g., screenshots, video clips).

Refund Process

Upon receiving a refund request:

We will review the request and respond within 7 business days.

If the refund request is approved, the client will receive a confirmation email, and the refund will be processed within 14 business days.

Refunds will be issued to the original payment method.


4. Delivery of Services

Turnaround Time: Final edited photos will be delivered within 14 business days after the photoshoot. Final edited video will be delivered within 21 business days after the video booking.


Delivery Method: Photos will be delivered via online photo gallery. Video will be delivered via google drive link for download. 


5. Client Responsibilities

Cooperation: Clients must ensure punctuality and cooperation during the photoshoot/videoshoot. Any delays or overtime caused by the client may incur additional charges.

Permissions: Clients are responsible for obtaining any necessary permissions for locations or subjects to be photographed.


6. Raw Footage Policy

JKP Photography LLC does not offer or provide raw photography or videography footage to clients. Our services include the delivery of professionally edited and finalized digital products only. This policy ensures that the quality of the work meets our professional standards and maintains the integrity of our creative process.


7. Behind-the-Scenes Footage Policy

JKP Photography LLC reserves the right to capture and post behind-the-scenes footage from events, including photos and videos of our team at work. This content may be used for promotional purposes on our website, social media channels, and marketing materials. 

Client Consent: By booking our services, clients consent to the use of behind-the-scenes footage. If the client wishes to opt out, they must notify us in writing prior to the event.

Privacy and Respect: We ensure that behind-the-scenes footage will be respectful and will not disclose any sensitive or private moments unless consented to by the client.


8. Printing and Tagging Policy

Printing: Clients are permitted to print photos for personal use. Prints can be made through JKP Photography LLC or any third-party printing service. However, the client may not use the photos for commercial purposes or alter the images in any way without prior written consent.

Tagging: When posting photos or videos provided by JKP Photography LLC on social media platforms, clients are encouraged to tag our official social media accounts and give proper credit. This helps maintain the integrity of our work and promotes our services. The appropriate tags and credit line will be provided to clients upon delivery of the final product.


9. Intellectual Property Rights

Ownership: We retain the copyright to all images and videos taken. Clients are granted a non-exclusive, non-transferable license to use the images and video for personal or business purposes.


Usage Restrictions: Clients may not resell, redistribute, or use the images or videos for commercial purposes without our explicit written consent.


10. Limitation of Liability

Service Quality: While we strive to deliver high-quality services, we are not liable for factors beyond our control, such as weather conditions, equipment failure, or unforeseen events.


Damages: Our liability for any claim arising from our services is limited to the amount paid by the client for the services.


11. Privacy Policy

We are committed to protecting your privacy. Personal information collected during the booking and delivery process will be used solely for providing our services and will not be shared with third parties without your consent.


 12. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute will be settled through mediation or arbitration in The United States District Court for The Eastern District Of California.


13. Changes to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the revised terms.
